• 1. This agreement constitutes an order for your portraiture services, including the taking of portrait photos as agreed to both parties: 1st 4 Memories Photography and contacting party (client). Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain property of 1st 4 Memories Photography and may be used for advertising, display or any other purpose thought proper by 1st 4 Memories Photography.
• 2. If photographer, 1st 4 Memories Photography, cannot perform this agreement in whole or in part due to a fire, or other casualty, acts of God or nature or terror or other cause beyond the control of the parties or due to Photographer's illness or injury, then 1st 4 Memories Photography will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in mail, or otherwise lost or damaged with fault on the part of photographer. Client(s) agree that an entire session cannot be replicated, reenacted or repeated for the purpose of a re-shoot and limits 1st 4 Memories Photography liability to the amount paid under this contract.
• 3. In the event of an extenuating circumstance on 1st 4 Memories Photography’s part, 1st 4 Memories Photography will find and hire an alternative photographer or reimburse the full amount paid to the client, including the deposit or will reschedule for a different time. 1st 4 Memories Photography will not be held liable for services not rendered. To receive refund, 1st 4 Memories Photography must have a 2-week notice from the schedule session.
• 4. On signing of this agreement by both parties hereto, 1st 4 Memories Photography will reserve the time agreed upon and will not make another reservation for the specific time frame.
• 5. 1st 4 Memories Photography is the only photographer to perform the photographic services requested on this contract. No other photographer is allowed to take photos at the session and no other cameras are allowed at the session.
• 6. The amount agreed upon covers the photographer’s time, talent, proofing and editing. It also cannot be changed or altered by any means.
• 7. A non refundable session fee is due at the time of booking your session. This guarantees the time and date allotted for you. Should payment not be received in this time frame, 1st 4 Memories Photography reserves the right to offer the date and time to another client.
• 8. 1st 4 Memories Photography price list is adjusted periodically and future orders will be charged at current pricing of that time.
• 9. 1st 4 Memories Photography will choose the best images from your session. No unedited raw files will ever be made available.  
• 10. The images purchased will be displayed in a password-protected online gallery. The online gallery will be available for 5 days only for you to download.
• 11. 1st 4 Memories Photography will contact you to arrange a personal viewing and ordering session at a time and date convenient to both parties online via zoom while we are in the current situation with Covid. This is to minimise contact where possible.  Please ensure all decision makers are present at the viewing session. Payment for all products are due when ordering. Once payment is received, orders are placed. Your order will be delivered approximately 2 weeks after your viewing session. Subsequent viewing sessions needed will be charged at £30 per viewing session. 
• 12. Portrait Care: Handle your portraits with extreme care. Damage incurred as a result of improper handling, framing or hanging is the responsibility of the client.
• 13. Sales are Final: Due to the custom nature of each session, all sales final.
• 14. Reprints: All ordered images will be kept on file for one year after your initial order. All images that are not ordered will be kept on file for 30 days only. You are welcome to place a reprint order from the images you originally purchased.
• 15. Payment Options: 1st 4 Memories Photography accepts cash, paypal (total under £200) or bank transfer.
• 16. Usage: 1st 4 Memories Photography reserves the right to use the digital images and/or reproductions for display, marketing, publication, competition or other purposes.
• 17. I am aware a full gallery of images produced by 1st 4 Memories Photography contains approx 20-25 images professionally hand edited images regardless of the number of images taken during a photo session. 
• 18. Due to current covid situation and social distancing measures, only those actively taking part in the photo session may attend. 
• 19. If you or anyone you have been in contact with in the last 7 days becomes ill in any way or is showing covid symptoms please call to reschedule your session. By not doing so you are putting at risk myself, my family and those who enter the studio in the following days after you. 
• 20. Social distancing will be observed at all times where possible during the session. 

Copyright Information:

It is illegal to edit, copy or reproduce these photographs elsewhere without 1st 4 Memories Photography’s permission, and violators of this Law will be subject to its civil and criminal penalties. All photographs, both on website and Facebook, including all potential proofs and purchased prints, are copyrighted; reproduction of any image by any means, including copying, re-printing, screen captures, and other means of print reproduction are strictly prohibited and are a violation of copyright law. Additionally, it is ILLEGAL to post any photographers work on the Internet, blogs and social networking sites, without the express permission of the photographer.

The only exception to this is if you have purchased the print release USB. As an artist, Rachel Burton of 1st 4 Memories Photography wishes to have complete control over the final look of her client's images, and screen shot or scanned images damage her reputation as a photographer by distorting and devaluing the image quality. Thank you for respecting 1st 4 Memories Photography’s work and livelihood by choosing not to reproduce her images without permission.

Model Release:

I hereby authorize 1st 4 Memories Photography to take and publish photographs taken of myself and/or the minor child or children listed below, and our names and likenesses, for use in the 1st 4 Memories Photography print, online and video-based marketing materials, as well as other 1st 4 Memories Photography publications.

I hereby release and hold harmless 1st 4 Memories Photography from any reasonable expectation of privacy or confidentiality for myself and for the minor child and children listed below associated with the images specified above. Further, I attest that I am the parent or legal guardian of the child or children listed below and that I have full authority to consent and authorize 1st 4 Memories Photography to use their likenesses and names. I further acknowledge that participation is voluntary and that neither I, the minor child, or minor children will receive financial compensation of any type associated with the taking or publication of these photographs or participation in 1st 4 Memories Photography marketing materials or other 1st 4 Memories Photography publications.

I acknowledge and agree that publication of said photos confers no rights of ownership or royalties whatsoever. I hereby release 1st 4 Memories Photography, its contractors, its employees and any third parties involved in the creation or publication of 1st 4 Memories Photography publications, from liability for any claims by me or any third party in connection with my participation or the participation of the minor children listed below.
